Welcome to Forge & Grind. "We," "us," and "our" refer to Forge & Grind. Forge & Grind operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with gear built for builders (the "Services"). Forge & Grind is powered by Shopify, which enables us to provide the Services to you.

The Terms below, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully — they cover your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree, please don't use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms, you confirm you're at least the age of majority in your state or province of residence, and you consent to any minor dependents using the Services on devices you own, purchase, or manage.

To use the Services — including browsing our store or purchasing products — you may be asked for information like your email, billing, payment, and shipping details. You confirm that all information you provide is correct, current, and complete, and that you have the right to provide it.

You're responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.

Section 2 — Our Products

We do our best to accurately represent every piece of gear we sell. That said, colors and product appearance may look different on your screen depending on your device and display settings.

We don't warrant that the appearance or quality of any product will exactly match what's shown in our store. Product descriptions may change at any time without notice, and we may discontinue any product or limit quantities available to any person, region, or jurisdiction at our discretion.

Section 3 — Orders

Placing an order is an offer to purchase — it's not final until we confirm and process your payment. Please review your order carefully before submitting, since we may not be able to accommodate cancellation requests once an order is accepted. If we're unable to accept, need to change, or cancel an order, we'll reach out using the email, billing address, or phone number provided at checkout.

Returns and exchanges are handled solely under our Refund Policy.

You confirm that your purchases are for personal or household use, not for resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions can change without notice. You'll be charged the price in effect at the time you place your order, as shown in your confirmation email. Posted prices don't include taxes, shipping, handling, customs, or import charges unless stated otherwise.

Prices in our online store may differ from prices in physical locations or on other platforms. Promotions may come with their own terms, which will govern in the event of a conflict with these Terms.

You agree to keep your purchase, payment, and account information accurate and current — including your email and card details — so we can process your order and reach you if needed.

You confirm that (i) the payment information you provide is accurate and complete, (ii) you're authorized to use the payment method, (iii) charges will be honored by your card issuer, and (iv) you'll pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes.

Section 5 — Shipping and Delivery

We print and ship with care, but we're not liable for shipping or delivery delays. Delivery times are estimates, not guarantees. We're not responsible for delays caused by carriers, customs processing, or anything outside our control. Once your order is handed off to the carrier, title and risk of loss transfer to you.

Section 6 — Intellectual Property

Everything that makes up our Services — trademarks, brand assets, text, images, graphics, reviews, video, and audio, along with how it's all arranged — belongs to Forge & Grind, its affiliates, or licensors, and is protected under U.S. and international law.

These Terms give you permission to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material from the Services without our written consent. Nothing here grants you rights to any Forge & Grind, Shopify, or third-party patent, trademark, copyright, or other intellectual property beyond what's expressly stated. Unauthorized use may violate federal and state IP law. All rights not expressly granted are reserved.

Forge & Grind's name, logo, product names, designs, and slogans (including "Clock Out. Build On.") are our trademarks. You may not use them without our written permission. Shopify's name, logo, and related marks belong to Shopify. All other names, logos, and marks on the Services belong to their respective owners.

Section 7 — Optional Tools

You may get access to third-party tools as part of the Services — tools we don't monitor or control. We provide access to these "as is" and "as available," without warranties or endorsement, and we're not liable for anything arising from your use of them. Use of optional third-party tools is entirely at your own risk — make sure you understand the provider's own terms before using them.

We may roll out new features over time. Any new features become part of the Services and fall under these Terms.

Section 8 — Third-Party Links

Our Services may link to third-party websites or content we don't operate. We're not responsible for evaluating or verifying third-party content, and if you leave our Services to visit a linked site, you do so at your own risk.

We're not liable for any harm related to your use of third-party sites, products, or services. Review third-party policies carefully before transacting, and direct any complaints about third-party products to that third party.

Section 9 — Relationship with Shopify

Forge & Grind is powered by Shopify, which enables us to deliver the Services to you. Any purchases you make happen directly with Forge & Grind — Shopify isn't responsible for any aspect of that sale, including injury, damage, or loss related to purchased products. You release Shopify and its affiliates from claims, damages, and liabilities related to your transactions with Forge & Grind.

Section 10 — Privacy Policy

All personal information we collect is subject to our Privacy Policy, and some information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm you've read both.

Because our Services are hosted by Shopify, Shopify collects and processes information about your use of the Services to help us operate and improve them. Your information may be shared with Shopify and other third parties, potentially in other countries, to provide these Services. See our Privacy Policy for full details.

Section 11 — Feedback

If you send us ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute it for any purpose, including commercial use — for example, to improve or promote Forge & Grind.

You confirm that (i) you own or have rights to the Feedback you submit, (ii) you've disclosed any compensation tied to it, and (iii) it complies with these Terms. We're under no obligation to keep Feedback confidential, pay for it, or respond to it.

We may, but aren't obligated to, monitor, edit, or remove Feedback we consider unlawful, offensive, or otherwise objectionable.

Your Feedback must not violate anyone's rights (copyright, trademark, privacy, or otherwise), contain unlawful or abusive content, or include malware. You may not use a false identity or mislead us about the origin of your Feedback. You're solely responsible for what you submit.

Section 12 — Errors, Inaccuracies, and Omissions

Occasionally, our site may contain typos, inaccuracies, or omissions related to product details, pricing, promotions, or availability. We reserve the right to correct these, update information, or cancel orders affected by inaccurate information at any time, without prior notice — even after you've placed an order.

Section 15 — Disclaimer of Warranties

Information on our Services is provided for general purposes only. We don't warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY FORGE & GRIND, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DON'T ALLOW THESE DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FORGE & GRIND, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — INCLUDING THOSE OF SHOPIFY — WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 17 — Indemnification

You agree to indemnify, defend, and hold harmless Forge & Grind, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

We'll notify you of any indemnifiable claim; a delay in notice won't relieve your obligations unless it materially harms your defense. We may control the defense and settlement of a claim at your expense, though we won't settle in a way that requires non-monetary action from you without your consent. You agree to cooperate with our defense, including by providing relevant documents.

Section 18 — Severability

If any part of these Terms is found unlawful or unenforceable, that part will be enforced to the fullest extent allowed, and the rest of the Terms remain valid and enforceable.

Section 19 — Waiver; Entire Agreement

Our failure to enforce any part of these Terms doesn't waive our right to do so later.

These Terms, along with any policies we post, make up the entire agreement between you and Forge & Grind regarding your use of the Services, superseding any prior agreements or communications. Ambiguities won't be construed against either party as the drafter.

Section 20 — Assignment

You may not transfer or assign these Terms or your rights under them without our written consent. We may transfer or assign these Terms without notice or consent.

Section 21 — Governing Law

These Terms are governed by the laws of the state where Forge & Grind is headquartered. You and Forge & Grind consent to the jurisdiction of the courts located there.

Section headings are for convenience only and don't affect the interpretation of these Terms.

Section 23 — Changes to These Terms

We may update these Terms at any time by posting changes to our site. It's your responsibility to check back periodically. We'll notify you of material changes as required by law. Continued use of the Services after changes are posted means you accept the updated Terms.
